Case Summary
Prosecutors allege that at least two people called the FBI to report that Timothy Earl O'Malley had been at the Jan. 6, 2021, riot at the U.S. Capitol and that one of those tipsters said O'Malley has previously identified himself as a Proud Boy. In an interview with the FBI, O'Malley said that he drove to Washington, D.C., from Florida to attend the pro-Trump rally. According to court documents, O'Malley wore a red softball batting helmet with a "Trump is my president" bumper sticker on the side, because he said he had heard that antifa followers had sacks of rocks they were planning to throw. In his interview, O'Malley described the scene at the Capitol as "mayhem" and admitted to entering the building, where he can allegedly also be seen on security camera footage. The FBI also obtained videos from O'Malley's cellphone through a warrant. In one video, O'Malley allegedly yells, "WE FOUGHT OUR WAY, ALL THE WAY IN THERE. AND WE FOUGHT OUR WAY BACK OUT ... WE SWARMED THE CAPITOL, THOUGH. HOT DAMN."
Case History
O'Malley pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced 4/12/2022 to 2 years of Probation; 20 hours of community service; $500 restitution; $10 special assessment. O'Malley received a full pardon on January 20, 2025
