Case Summary
Terry Allen marched toward the Capitol on Jan. 6, 2021, carrying a black and red flag on a 5-foot-long, wooden flag pole that he used to attack police officers, according to federal prosecutors. Allen also used metal fencing to both prevent police from using them as a defensive barrier and to clear the space for rioters engaging with police. In early 2023, a Pennsylvania state police trooper identified Allen based on images, because he recognized him after stopping his vehicle three years earlier and citing him for traffic violations. Another witness, who has known Allen for a decade, told the FBI he has a stockpile of guns, food and propane. According to court documents, Allen served two years in county jail for repeatedly slamming the head of an officer on the pavement in the early 80s. He pleaded guilty to felony aggravated assault.
Case History
Allen pleaded Not Guilty to all charges. Found Guilty on all charges but one, Count 2 (Assaulting, Resisting, or Impeding Certain Officers Using a Dangerous Weapon) in a Bench trial on 7/11/2024. Sentenced on 11/14/2024 to 24 months incarceration; supervised release of 24 months; special assessment of $520; restitution of $1,000; 100 hours of community service. Allen received a full pardon on January 20, 2025
