Case Summary

Court documents allege that the FBI was tipped off to Samuel Fox’s involvement in the Jan. 6, 2021, riot by a college friend of his. The tipster saw him post pictures from inside the U.S. Capitol on his Facebook feed. A screenshot in the court papers of the Facebook post show the images, along with this caption: "Al [sic] the lefties pissing and moaning right now can take comfort in the fact we walked into a building that was ours instead of using politics to loot stores, We actually have reasons to be there, not virtue signalling twitter points.... I’d do it again, fight me.” The FBI says that surveillance footage of Jan. 6, 2021, show someone they identify as Fox from inside the Capitol, showing that he entered through a broken window, and more images of him using his cellphone to capture photos or video. Later, using a search warrant to get records from Google, the FBI used Fox’s cellphone to find his geographic location at the time of the riot and confirmed that the area included the inside of the Capitol building. A search warrant served to Facebook by FBI agents unearthed deleted posts from Fox had been preserved by the company, including one comment from Fox, reading: “The capitol wasnt overthrown we were let in.”
