Background

Following an eight-week trial, an April 2017 jury convicted Melgen of 67 counts of health-care fraud and related offenses. DOJ's February 22, 2018 release reports seventeen years plus three years supervised release. Later amended restitution differs from the preliminary sum; use the amended judgment.

Original Case

DOJ lists: Health care fraud (36 counts); false, fictitious and fraudulent claims (19 counts); false statements relating to health care (11 counts). Sentence: 204 months' imprisonment; three years' supervised release; $52,997,442 restitution (as amended April 5, 2018) (February 22, 2018). Plea/trial history and any amendments beyond this table require case-document review.

Clemency

January 19, 2021 commutation reduced imprisonment to time served. Warrant explicitly preserved unpaid restitution ($52,997,442), the $6,700 assessment, three years supervised release and other sentence components. The warrant's typed year appears inconsistent with the action date; retain DOJ's indexed 2021 date and flag the document typo.

Trump Connection

White House identified Bob Menendez and Mario Diaz-Balart among commutation advocates. That statement does not establish a direct Trump relationship.
