Background

On November 15, 2019 a jury convicted Stone of obstruction of a congressional investigation, five false-statement counts and witness tampering, concerning the House investigation of Russian interference in the 2016 election.

Original Case

Roger Stone was prosecuted for his conduct during the House Intelligence Committee's investigation of Russian interference in the 2016 election and the publication of stolen documents by WikiLeaks. Prosecutors said Stone lied to Congress about the identity of a person he had described as a back channel to WikiLeaks, his requests to that intermediary, his written communications, and his discussions with people connected to the Trump campaign. The government also alleged that Stone pressured radio host Randy Credico to support Stone's account, claim not to remember events, or invoke the Fifth Amendment rather than testify. A federal jury convicted Stone in November 2019 of obstructing the congressional investigation, making five false statements, and witness tampering. In February 2020, the court sentenced him to 40 months in prison, two years of supervised release conditioned on 250 hours of community service, and a $20,000 fine.

Clemency

Trump acted twice. On July 10, 2020, before Stone began serving the prison term, he commuted the custodial and supervised-release portions of the sentence. On December 23, 2020, Trump granted Stone a full and unconditional pardon. Neither action overturned the jury's verdict through the courts.

Trump Connection

Stone was a longtime Republican political consultant and an outspoken Trump supporter whose association with Trump predated the 2016 presidential race. He advised Trump's campaign during its early months and remained publicly aligned with him after leaving his formal role. The conduct at issue in Stone's criminal case included lies about whether he had discussed his claimed WikiLeaks intermediary with people connected to the Trump campaign. Trump repeatedly criticized Stone's prosecution and sentence. In commuting the prison term, the White House described Stone as the victim of an unfair investigation, emphasized his support for Trump and opposition to Hillary Clinton, questioned the prosecution and jury process, and cited Stone's age and medical condition. Those claims were the administration's clemency rationale, not findings that displaced the jury's verdict.
