Case Summary

Richard Markey entered the tunnel of the Capitol on Jan. 6, 2021, by climbing on top of other rioters in order to move closer to the line of law enforcement, according to the FBI. Once Markey reached the line, he allegedly used a baton to hit an officer’s face shield with it and he also managed to hit another officer on the head. After the altercation, another officer managed to take the baton away from Hoffman, yet he continued to swing at them striking multiple officers with substantial force. CCTV footage also shows Markey yanking a police shield and striking more with it, as well as a flagpole he is able to obtain. Court records state that he can also be heard yelling on video saying: “Oath breaker. Oath breaker. You’re not doing your f***ing job. Listen! I fought for this f***ing country.” According to a sentencing memo filed in court by the defendant, Markey served in the U.S. Coast Guard.

Markey pleaded Guilty to one charge: Assaulting, Resisting or Impeding Certain Officers Using a Dangerous Weapon. The other charges are dismissed. Sentenced on 12/6/2024 to 30 months incarceration; 36 months of supervised release; $2,000 in restitution; $100 special assessment. Markey received a full pardon on January 20, 2025
