Case Summary
Federal prosecutors allege that Nathaniel DeGrave had been planning to attend the pro-Trump rallies on Jan. 6, 2021, for at least several days. In response to Donald Trump's Facebook message calling for a "StopTheSteal" protest, DeGrave posted, "We're ready Mr President!!" When he made it to Washington from his home in Las Vegas, DeGrave, who goes by Nate, allegedly appeared in a video where he said, "We are out here protecting the country, if s**t goes down, if Pence does what we think he is going to do. Then we are here to defend this city, defend any city in this country. Let antifa try us. We are here. We are ready. I say bring it. We are not silent anymore." By 2:40 p.m. on Jan. 6, prosecutors say, DeGrave had entered the Capitol building wearing "black tactical gear, including what appears to be body armor, a helmet, and a mask/face shield." Surveillance footage allegedly shows DeGrave getting into a "shoving match" with officers from the U.S. Capitol Police, putting up his fists and pounding his chest. DeGrave was arrested on Jan. 28, 2021.
Case History
DeGrave pleaded Guilty to two charges: Conspiracy and Assaulting, Resisting, or Impeding Certain Officers. The other charges are dismissed. Sentenced on 5/10/2023 to 37 months of incarceration; 36 months of supervised release; $25,000 fine; restitution of $2,000; $200 special assessment. DeGrave received a full pardon on January 20, 2025
