Case Summary

“Things got a little crazy,” Mitchell Todd Gardner II allegedly told someone he met a few weeks after the U.S. Capitol riot. According to a criminal complaint filed against him, Gardner told this person that he had been at the Capitol on Jan. 6, 2021. That unnamed person, court papers say, called an FBI tip line and identified Gardner as one of the rioters. Prosecutors say they have photographs and videos that show Gardner in a red Trump hat with some sort of canister in his hand. The images allegedly show him standing on a window ledge on the Senate side of the Capitol. He’s seen on video, court papers say, damaging a window with the canister and then spraying U.S. Capitol Police with its contents. Prosecutors described Gardner as having taken a “defacto leadership role” in the melee that day at the Capitol.
