Case Summary

The day after the Jan. 6, 2021, riot at the U.S. Capitol, a tip was submitted to the FBI showing a screenshot of an Instagram story. It showed a man in a red Trump hat, wearing a black hoodie with an orange Q on it. The photo also included an emoji of eyes and the caption, “If you know, you know…” The tipster did, in fact, know, and identified the man to the FBI as Michael Marroquin, according to federal court documents. Marroquin had posted several times on Facebook about plans to attend former President Trump's rally in Washington, D.C., and also allegedly posted after the riot as well, saying he was there and claiming Antifa were among the crowd. In August of 2021, the FBI received a package containing a Verizon phone and the message: “THERE IS PHOTO, VIDEO AND OTHER EVIDENCE ON THIS DEVICE THAT IMPLICATES THE OWNER AS A PARTICIPENT [sic] IN THE JANUARY 6, 2021 CAPITOL RIOT." On the phone, there were multiple recordings that Marroquin allegedly took inside the Capitol that day, including one looking through a broken door at the faces of law enforcement with their weapons drawn. In an interview with the FBI, Marroquin admitted to entering the building, court records state. He also said he fell asleep on a train on the way back to his hotel. When he woke up, his cell phone was gone and he had not seen it since.

Case History

Marroquin pleaded Guilty to five charges (not Obstruction). Sentenced on 12/9/2024 to 6 months of incarceration; 1 year of Supervised Release; Special Assessment of $80; Restitution in the amount of $500. Marroquin received a full pardon on January 20, 2025
