Case Summary
According to a criminal complaint, federal investigators believe Mark Simon, a "far-right activist," allegedly recorded a video on Jan. 6, 2021, that shows numerous individuals pushing their way into the U.S. Capitol while law enforcement officials attempted to remove individuals from inside the building. In the video, captioned “Peacefully Storming the Capitol…#StopTheSteal,” Simon can allegedly be heard saying, “In the Capitol baby, yeah!” Other Facebook photos allegedly show Simon and an unidentified woman also posing around the Capitol grounds. Simon described his experience to Epoch Times, a right-wing newspaper. Simon told the newspaper that he attended the rally in support of President Trump, explaining that the crowd was made up of “frustrated patriots” who “just wanted to be heard.” “If the patriots wanted to get in there and cause damage or burn the Capitol down or get Congress or hurt anybody, they would have got hurt,” he said. “They had full control of the place. Cops had no control throughout the day. We could have gone wherever we wanted at any time, and it was not done. They were restrained.”
Case History
Simon pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges were dismissed. Sentenced 12/7/2021 to 35 days incarceration; Special Assessment of $10; Restitution in the amount of $500. Simon received a full pardon on January 20, 2025
