Case Summary

Federal prosecutors allege that Mark Middleton, along with his wife, Jalise Middleton, traveled from Texas to Washington, D.C., where they assaulted police officers outside the Capitol building on Jan. 6, 2021. According to court documents, police officers repeatedly ordered Mark Middleton to “get back,” to which he responded, "f*** you, and pushed against a barricade protecting the Capitol. Middleton then allegedly grabbed a police officer's wrist and pulled him forward and grappled with officers "as various flags are jabbed toward the officers’ faces." Police used a chemical spray on him and his wife, forcing them to retreat, court documents say. Prosecutors say that Mark Middleton then posted on Facebook, "We are on the front lines. We helped push down the barriers. Jalise and I got pepper sprayed, clubbed, and tear gassed. We had to retreat, but more patriots pushed forward, and they’re taking back our house." The Dallas Morning News reported that Mark Middleton had said on LinkedIn that he works in sales for an internet services company. The Middletons were arrested in Texas on April 21, 2021.

Case History

Middleton pleaded Not Guilty to all charges. Found Guilty on all charges in a Jury trial on 2/13/2024. The Court dismisses the Obstruction charge on 9/3/2024. Sentenced on 10/22/2024 to 30 months incarceration; 36 months supervised release; $2,000 fine; $395 special assessment. Middleton received a full pardon on January 20, 2025
