Case Summary

Kevin Loftus was photographed carrying an American flag in the rotunda of the U.S. Capitol building. Court documents claim he posted these pictures to Facebook saying that he was "one of 700 inside" and that "some of us are in it to win it." He later posted a New York Post article to his Facebook profile, noting, "i am wanted by the FBI for illegal entry." Former Wisconsin state Sen. David Zien described Loftus as a patriotic and commendable veteran to WQOW. He claimed Loftus did not act maliciously within the Capitol building. "The crowd was so wrapped up in the magic of the moment, they were pushing, and he couldn't have turned back if he would have wanted to," Zien told WQOW. Loftus told NPR in an interview that he signed up for a membership with the The Oath Keepers in 2016, and participated in one event with the extremist group. He said he stopped paying dues to the Oath Keepers in 2019 and disavowed the group. In his interview with NPR, Loftus discussed his Army service in the 1990s.

Loftus pleaded Guilty to Parading, Demonstrating, or Picketing in a Capitol Building. The remaining charges were dismissed. Arrested 10/31/2024 in Iowa for probation violation and resentenced on 12/13/2024: court revokes probation and sentences him to 6 months of incarceration. Loftus received a full pardon on January 20, 2025
