Case Summary
According to court documents, law enforcement received an online tip with a photo of Kerry Wayne Persick participating in the Jan. 6, 2021 riot. In the photo, Persick reportedly was wearing a dark-colored jacket, a backpack and a red baseball cap with a “Make America Great Again" logo. The FBI said it later identified Persick on videos taken inside the U.S. Capitol building by using this photo. The tipster, who has known Persick for almost 20 years, also allegedly identified him in videos the FBI obtained. In addition, the FBI investigation revealed that Persick’s phone was identified as having used a cell site tower consistent with providing service to a geographic area that included the Capitol building's interior, according to an affidavit.
Case History
Persick pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced 7/14/2022 to 36 months Probation with 90 days home detention/location monitoring; $10 special assessment; $5,000 fine; restitution of $500. Persick received a full pardon on January 20, 2025
