Case Summary

On Jan. 6, 2021, Kenneth Duncan Massie entered the U.S. Capitol building through the Senate Wing door, according to court documents. Surveillance footage allegedly shows him wearing a white cowboy hat, with the American flag under the rim. Massie was allegedly accompanied by two men -- Luke Faulkner and Jared Kastner, who are both also charged in relation to the riot. The three men moved through the Capitol's Crypt in a row, each with a hand on the shoulder of the person in front of them, court records say. The FBI arrested Faulkner and Kastner on Dec. 8, 2021. According to court documents, both men identified Massie as the third person with them. On Dec. 9, 2021, the FBI then interviewed Massie, who allegedly admitted to having entered the Capitol. He also provided the FBI with a black jacket that he said he wore that day, as well as the cellphone he used, but said he had deleted the images taken while at the Capitol building, court records indicate. According to a sentencing memorandum filed in federal court by the U.S. Department of Justice, Massie served in the U.S. Army from 1992 to 1993.

Case History

Massie pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced on 4/20/2023 to 24 Months Probation; 30 days location monitoring; 60 hours of community service; $500 Restitution; $10 Special Assessment. Massie received a full pardon on January 20, 2025
