Case Summary
Justin Stoll allegedly attended the Jan. 6, 2021 riot at the U.S. Capitol. But his charges are not directly related to his presence there. Stoll, a social media personality who goes by the name Th3RealHuckleberry, lives in the Southern District of Ohio. According to his website, Th3RealHuckleberry is a social media content creator who “produces content in the political, comedic and general hot topic news areas, but he is most well-known for his clapbacks.” According to court documents, Stoll can be heard on his social media posts from that day saying, “D.C.’s a war zone. ... You ain’t got enough cops, baby! We are at war at the Capitol. ... We have taken the Capitol. This is our country.” After Stoll allegedly posted this content on YouTube, he received responses from other online users that he should be arrested. This allegedly prompted Stoll to respond: “If you ever in your f***ing existence did something to jeopardize taking me away from my family, you will absolutely meet your maker. You can play that for the D.A. in court, I don’t care. If you ever jeopardize me from being with my family, you will absolutely meet your mother f***ing maker, and I will be the one to arrange the meeting.” The court documents describes his demeanor in the video as “serious and aggressive." An Army spokesperson confirmed to NPR that Stoll served in the Army between September 1998 and December 2000 and his rank was a private.
Case History
Stoll pleaded Guilty to the charge. Sentenced on 7/27/2022 in Cincinnati before Judge Susan J. Dlott: 24 months probation; $100 special assessment. On 5/23/2024, Stoll was discharged from supervision and the proceedings in the case were terminated. Stoll received a full pardon on January 20, 2025
