Case Summary
“A huge group of us stormed inside … we were basically shouting at the cops,” says Josiah Hueso in CNN footage shot outside the U.S. Capitol riot on Jan. 6, 2021, according to an FBI statement of facts. A tipster who’d known Hueso for some time sent a link of the video to the FBI, adding that they’d heard Hueso “brag” about his involvement at the Capitol, according to the statement. The FBI claims surveillance footage shows Hueso entering the Senate side of the Capitol and heading into the parliamentarian office at one point. People were picking up items inside the office, Hueso later told the FBI, but he says he told them not to steal anything. He was arrested May 25, 2022, in San Diego.
Case History
Hueso pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced on 8/8/2023 to 36 months probation; restitution of $500; special assessment of $10; 50 hours of community service. Hueso received a full pardon on January 20, 2025
