Case Summary

In November of 2022, a confidential source contacted the FBI to alert the bureau that Joseph Pastucci had been inside the U.S. Capitol on Jan. 6, 2021, according to federal court records. That source identified Pastucci because he's wearing the same hat in a profile photo on a dating website that he wore on the day of the riot. Pastucci can allegedly be seen in surveillance footage from the building, alongside his wife Jeanette Mangia, who is also charged. Court records state that Pastucci and Mangia walked around the building for more than an hour in total and entered both the office of then-House Speaker Nancy Pelosi and the Senate Chamber. Both Pastucci and Mangia were eventually asked to leave the building by police but resisted, according to court documents. An officer had to push Pastucci out of the building and Pastucci shoved another officer in the chest, court documents indicate. The pair allegedly reentered for a second time later on.

Case History

Pastucci pleaded Not Guilty to all charges. Found Guilty in a Stipulated Bench trial on 4/26/2024 on all charges but one: Parading, Demonstrating, or Picketing in a Capitol Building. On 9/30/2024, the court vacated the Guilty Verdict as to all counts. Pastucci pleaded Guilty to one charge: Assaulting, Resisting, or Impeding Certain Officers. Sentenced on 12/20/2024 to 26 Months Incarceration; Supervised Release Of 36 Months (With Conditions); Restitution Of $2,000; Special Assessment Of $100. Pastucci received a full pardon on January 20, 2025
