Case Summary
Jerry McKane Waynick allegedly rushed a police line outside the U.S. Capitol, attempted to grab an officer’s baton and threw a barrier or cone at officers. Prosecutors say Jerry Waynick and his father, Mark Waynick, who is also charged, wore black tactical helmets and vests at the Jan. 6, 2021, riot. Both are alleged to have entered the Capitol through the Senate wing doors, spending about half an hour inside. The FBI says it used Jerry Waynick’s Instagram account to isolate a phone number that cellphone data shows was inside or near the Capitol on the day of the attack. Court records also indicate that a local sheriff’s deputy was able to positively identify both Waynick men. Jerry Waynick's Instagram indicates he attended Nashville State Community College, court records say.
Case History
Waynick pleaded Not Guilty to all charges. Found Guilty on all charges in a Bench trial on 4/17/2024. Sentenced on 11/26/2024 to 30 months of Incarceration; 36 months of Supervised Release (with conditions); Restitution of $2,000. Waynick received a full pardon on January 20, 2025
