Case Summary
Jacob Garcia of Burleson, Texas, allegedly posted to Facebook on Jan. 7, 2021, writing “MY ONLY REGRET IS NOT GETTING SOME SOUVENIRS,” and “THERE’S NO WAY IN HELL THEY WILL ASCEND BACK TO POWER AS THEY WISH IF THEY DON’T GET RID OF US ALL. SURVIVAL OF THE FITTEST." The day before those posts went up, prosecutors say, the Burleson Police Department reported that Garcia indicated on Facebook he’d entered the U.S. Capitol. The FBI says they also found posts from before the Capitol riot that included comments such as “Get ready DC” and “IT’S TIME TO RISE THE F*** UP.” Investigators examining Garcia’s Facebook page also allegedly found GoPro style video footage that they were able to match with CCTV footage from inside the Capitol. The FBI also says Garcia’s childhood friend positively identified him in photos, including from inside the Capitol. The same friend told the FBI that Garcia’s belief in QAnon and other conspiracy theories “changed his behavior.” Through Facebook, investigators say they found a phone number for Garcia that had used cell sites in an area that includes the Capitol and that Garcia called a cannabis delivery service in Washington, D.C., on Jan. 5, 2021. That phone number is registered to Garcia’s mother, who said that she told investigators she did not travel to Washington and that the number belongs to one of her children.
