Case Summary
Federal prosecutors allege that Gary Wilson breached the U.S. Capitol building on Jan. 6, 2021, along with two other men: Patrick Montgomery and Brady Knowlton. Wilson wore a T-shirt from the far-right conspiratorial news site Infowars depicting a Revolutionary War soldier with an automatic weapon, according to charging documents. Wilson was in close proximity to multiple violent clashes between rioters and police in and around the Capitol, prosecutors say, though they do not accuse Wilson of committing violence himself. During one confrontation with police, Wilson allegedly told officers, "We came all the way from our jobs to do your job and the freaking senators’ job.” Charging documents state that federal investigators confirmed Wilson's presence in the Capitol through flight records, cellphone records, an interview with a family member of Wilson and videos from multiple sources at the Capitol. The FBI arrested Wilson on Sept. 13, 2021.
Case History
Wilson pleaded Not Guilty to all charges. Found Guilty on one charge in a Stipulated Bench trial on 3/20/2024: Theft of Government Property. The other charges are dismissed. Sentenced on 7/2/2024 to 30 days incarceration; 12 months supervised release; $500 restitution; $25 special assessment. Wilson received a full pardon on January 20, 2025
