Case Summary

Evan Neumann, prosecutors allege, is one of the rioters who engaged law enforcement in a prolonged struggle near a bike rack barricade in front of the U.S. Capitol on Jan. 6, 2021. Body camera footage allegedly shows Neumann wearing a red “Make America Great Again” hat and wearing a gas mask for some of the time, and yelling at one officer a common QAnon conspiracy theory that the officer is “defending the people who are going to kill your f**king children ... they are gonna kill your f**king children, they are gonna rape them, they are gonna imprison them, and you’re defending the people that are going to do this to your children.” According to court documents, Neumann refused orders by police to move back, and later, after a violent back and forth over the barricade along with other rioters, wrested it from the officers’ hands and used it as a battering ram to break the police line. FBI agents say they identified Neumann in multiple ways: via an anonymous tipster claiming to be a family friend, by comparing passport photos and social media profiles, and by analyzing data obtained from Google that places a mobile device with a number that Neumann confirmed was his geographically within the Capitol at the time of the riot on Jan. 6, 2021.

Case History

Neumann fled to Belarus and applied for asylum there. He was granted asylum in March, 2022. On 3/11/2022, Neumann's case was directly reassigned to the Calendar Committee as the defendant is a fugitive. On 1/24/2025, the motion to quash Arrest Warrant on a Complaint is granted. On 1/27/2025, the court grants the government’s motion to dismiss the case with prejudice.
