Case Summary

Dusty Allan Higgins served in the U.S. Navy as a law enforcement specialist from 2002 to 2007, according to an FBI statement of facts. FBI agents say a tipster sent them a video from Higgins’ social media accounts showing him inside the U.S. Capitol on Jan. 6, 2021. The tipster claimed Higgins considers himself a member of the Proud Boys, according to the FBI. When interviewed just a couple weeks after the riot, Higgins told FBI agents: “Our Constitution tells us that when we have a treasonous government, they should be overthrown.” He also reportedly said he traveled to Washington, D.C., alone and clarified that he didn’t want to overthrow the government, but simply make a statement. Surveillance footage from the riot allegedly shows Higgins climbing through a broken window, snapping photos in the Capitol Crypt and wandering through various areas of the building.

Case History

Higgins pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in Capitol Building. The other charges are dismissed. Sentenced on 3/8/2024 to 36 Months Probation; 14 days intermittent confinement; $500 Restitution; $10 Special Assessment; 50 hours of community service. Higgins received a full pardon on January 20, 2025
