Case Summary

In subpoenaed Facebook messages sent a few weeks before Jan. 6, 2021, Dustin Sargent described plans to apprehend treasonous government employees and suggested that the penalty for treason is death. “They may publicly be hung,” he wrote in a Facebook message included in an FBI statement of facts. On Jan. 6, the FBI claims Sargent entered the U.S. Capitol on two separate occasions: once by climbing through a window on the west side and again through the east Rotunda doors. At those doors, Sargent was among rioters who sang the national anthem and then assaulted two officers trying to stop them from getting into the building, the FBI statement claims. Once he reached the House of Representatives Chamber, Sargent was filmed admonishing officers blocking their access. “You’re supposed to be with us!” Sargent said, according to the FBI statement. “This is our chance. If we don’t succeed, it’s over.”

Case History

Sargent pleaded Not Guilty to all charges. On 11/4/2024, the Obstruction charge was dismissed. On 1/21/2025, the court grants the government’s motion to dismiss the case with prejudice
