Case Summary
Court documents state that David Daniel entered the Capitol twice on Jan. 6, 2021, wearing a cap with what appears to be a patch or embroidery of the animated character “Vault Boy” from the “Fallout” video game franchise. The first entry came after a violent pushing match against law enforcement and the barricaded Senate Wing door - he exited after getting some chemical irritant spray in his face. He then went back inside to the Crypt and the Senate Wing door area. At some point during the violent push against officers, he lost the cap. He was arrested on Nov. 30, 2023, in North Carolina.
Case History
Daniel pleaded Guilty to one charge: Assaulting, Resisting, or Impeding Certain Officers. Sentencing set for 5/5/2025. On 1/23/2025, the court grants the government’s motion to dismiss the case with prejudice. The Defendant shall be released from custody as to this case only.
