Case Summary
According to a criminal complaint, Daniel Phipps was identified when the FBI received a tip from a Fort Worth Police analyst who was monitoring social media to locate local residents who participated in the Jan. 6, 2021, riot. Phipps allegedly commented on a Facebook post about a bus that was planning to travel to D.C. for the protest. Further investigation revealed a Facebook photo of Phipps inside the Capitol building with an American flag draped over his shoulder. “Everyone talks about being a patriot until its time to do patriot s---,” he allegedly wrote in another Facebook post, according to court documents. “I went to DC. I helped take the Hill. I helped other patriots prevent Antifa from damaging anything. I exercised my 1st amendment right to take grievances to our representatives. It was a (mostly peaceful) political protest.” According to a sentencing memorandum filed in federal court, Phipps served in the U.S. Navy from 1995 until 1996.

Phipps pleaded Guilty to all charges. Sentenced on 8/10/2023 to 27 Months of Incarceration; 36 months supervised release; special assessment of $270. Phipps received a full pardon on January 20, 2025
