Case Summary

Clive Kincaid was first identified by federal authorities after they determined his cell phone had been inside the U.S. Capitol on Jan. 6, 2021, according to federal court documents. Kincaid can allegedly be seen in video from that day verbally engaging with police officers, holding onto a bike rack as other rioters pulled it away from the officers, and holding what appeared to be pepper spray. He can later be seen in surveillance footage from inside the building, court records state. In an interview with The Durango Herald, Kincaid claimed he was hit by six rubber bullets and confronted police about it. In the interview, he also admitted to entering the building, saying he wanted to see "what in the heck is going on.” He also said he wished members of Congress had spoken to the mob on Jan. 6. Related to his criminal charges, he told the newspaper: “If they throw me in the clink, whether it's for six months or 10 years – I hope they'll let me have books."
