Case Summary
Federal prosecutors allege that Caleb Berry conspired with members of the extremist anti-government militia group known as the Oath Keepers to disrupt Congress on Jan. 6, 2021. Berry allegedly participated in planning meetings with members of the group via both GoTo Meeting and the encrypted messaging app Signal. Prosecutors say that Berry and "and others known and unknown dropped off firearms at the Comfort Inn Ballston hotel in Arlington, Virginia" on Jan. 5, 2021, prior to the storming of the Capitol. During the storming of the Capitol, Berry allegedly helped form a military-style "stack" formation with other members of the Oath Keepers as they pushed up the stairs outside the Capitol and forced their way into the Rotunda. Later, after exiting the Capitol, Berry and other members of the Oath Keepers met together about 100 feet from the building, according to court papers. Berry agreed to cooperate with federal investigators as part of a plea agreement.
