Case Summary
Sometime around Jan. 10, 2021, the FBI received an online tip with an Instagram picture of a man inside the U.S. Capitol. The Instagram account name on the photo was Bryan Emmanuel Bustos, according to court documents. Security footage reviewed by the FBI confirmed that the picture was indeed taken inside the building on Jan. 6, 2021, prosecutors say. The FBI also reviewed Bustos’ Instagram account, which allegedly had images of another individual, Alexis Ivan Bustos, outside and inside the Capitol building. According to the FBI, the two men traveled together to Washington, D.C., from California, where they share the same address and a cellphone plan. Both men are charged in the riot. Bryan Bustos allegedly entered the Capitol through the Columbus doors at the building's eastern side while carrying a large U.S. flag. On June 17, 2021, the FBI interviewed a restaurant co-worker of Bryan Bustos who reportedly confirmed his identity.

Bustos pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced on 2/15/2023 to 24 months of Probation; 30 hours of community service; $500 Restitution; $10 Special Assessment. Bustos received a full pardon on January 20, 2025
