Case Summary

Brian McGee entered the U.S. Capitol on Jan. 6, 2021, with Jeremy Harrison, whom he had previously met online and who is also charged, according to an FBI statement of facts. McGee was allegedly inside the Capitol for one minute and 51 seconds. In October 2021, the FBI spoke to three of McGee's former coworkers. One was his former supervisor with the Missouri National Guard, who positively identified him in images taken from Capitol surveillance footage, court records indicate. Court documents state that during a conversation with the FBI over the phone, McGee said that he saw police officers waving rioters inside and fist-bumping them. An FBI review of surveillance footage does not back this up. On Feb. 14, 2022, McGee was interviewed by the FBI where he identified himself in surveillance footage. He later provided the clothing that he was wearing when he allegedly entered the Capitol. McGee was arrested on Feb. 9, 2023, in Jefferson City, Mo. According to sentencing memos filed in court, McGee served in the U.S. Air Force and the Army National Guard.

Case History

McGee pleaded Guilty to one charge: Parading, Demonstrating, or Picketing in a Capitol Building. The other charges are dismissed. Sentenced on 11/8/2023 to 36 Months Probation; 7 days intermittent confinement; $10 Special Assessment; Restitution in the amount of $500; 60 hours of community service. McGee received a full pardon on January 20, 2025
