Case Summary
Federal prosecutors allege that Avery MacCracken assaulted police officers guarding the U.S. Capitol on Jan. 6, 2021. MacCracken allegedly punched one officer "with his closed fist in the right cheek, causing a cut to the face under his right eye" and pushed and shoved another officer. Both incidents were allegedly captured by police body cameras. Court documents state that MacCracken is "considered a transient with no permanent place of residence" but is generally known in the Telluride, Colo., area. A tipster from Colorado recognized MacCracken in photos of the Capitol siege circulated by the online open-source investigative community known as the Sedition Hunters, prosecutors now allege. That tipster then contacted local law enforcement -- namely, San Miguel County Sheriff Bill Masters -- who reportedly recognized MacCracken as well as the outfit he wore on Jan. 6, 2021, court documents state. MacCracken was arrested on Dec. 11, 2021.
Case History
MacCracken pleaded Guilty to one charge: Civil Disorder. The other charges are dismissed. Sentenced on 5/16/2024 to 1 year and 1 day incarceration with credit for time served; 36 months of Supervised Release; $100 Special Assessment; Restitution in the amount of $2,000; 240 hours of community service. MacCracken received a full pardon on January 20, 2025
