Case Summary

Anthony Mariotto, who goes by Tony, summed it up in a smiling Facebook photo taken from the balcony of the Senate gallery on Jan. 6, 2021. “I’m in,” it said. “And there are just a few This is our house.” The post was sent to authorities by a private citizen who said they had known Mariotto for about a year. According to court documents, the FBI found Mariotto in Georgia 10 days after the breach of the Capitol building and interviewed him over the phone. Mariotto said that he and his wife had listened to Donald Trump’s speech and then followed the crowd to the Capitol. Mariotto allegedly told the agent that he thought he “was being part of history” and walked through the Capitol chanting, “USA.” He conceded he knew he was not allowed to be there, the court documents said. Mariotto voluntarily met with an agent and gave him his phone, and the agent found the selfie that the private citizen had sent to authorities.
