Case Summary
Prosecutors allege that Andy Oliva-Lopez fired an orange chemical spray at police officers protecting the outside of the U.S. Capitol during the Jan. 6, 2021, riot. Oliva-Lopez was wearing a blue plaid shirt and a gas mask during the riot, according to court documents, and appeared in some of the most widely seen images of that day's violence. The government alleges that Oliva-Lopez purchased bear spray in the month before the Capitol riot, which appears to be consistent with the spray Oliva-Lopez allegedly used. The FBI arrested Oliva-Lopez on Jan. 23, 2024.
Case History
Oliva-Lopez pleaded Guilty to the single charge. Sentenced on 1/17/2025 to 51 months incarceration; 36 months Supervised Release with special conditions; Restitution of $2,000; Special Assessment of $100. Oliva-Lopez received a full pardon on January 20, 2025
